Acknowledgement & Acceptance of Risks & Liability Waiver
In consideration for attending the Night Lights Sky Lantern Festival, you agree to the following Acknowledgment and Acceptance of Risks, and Liability Waiver.
Definitions:
The term “Night Lights” includes Night Lights Event, LLC and ATH Events, LLC. You, as well as any minor child that accompanies you to the Event, will be referred to as the “Participant.” The term “Event” means the Night Lights’ Sky Lantern Festival. The Event begins the moment you enter the designated parking area, continues through the ticketing process, Event activities, and the release of the sky lanterns, and ends when you leave the Event venue. The “Event venue” refers to the place in which the Event takes place, including designated parking areas.
Terms and Conditions:
In consideration for being allowed to participate in any way in the Event, you acknowledge and covenant that you have read and consent to the following:
The undersigned Participant hereby agrees to ASSUME ALL RISKS associated with their participation in the Event. The Participant agrees to HOLD HARMLESS, RELEASE, DEFEND, AND INDEMNIFY Night Lights Event, LLC, ATH Events, LLC, Radiate Outdoor Supply, LLC, the Event venue, the owners, operators, contractors, and employees of said companies, and their affiliated organizations and companies, insurance carriers, parents, agents, representatives, assignees, officers, and directors (each hereinafter a "Released Party") for ANY AND ALL LIABILITY and claims for any and all injuries or death to persons or damage to property arising from the Participant’s participation in the Event, including those claims based on any Released Party’s alleged or actual NEGLIGENCE or breach of any express or implied WARRANTY. In the case of a minor participant, the minor participant’s parent or legal guardian acknowledges that they are also agreeing to this Liability Waiver on behalf of the minor participant and that the minor participant shall be bound by all the terms of this agreement.
Releasing sky lanterns and participating in any Event activity can be dangerous and could result in damages to your person or property. You participate in the Event at your own risk. Participant understands and acknowledges that they have been informed and understand all Event rules and regulations, and agrees to comply with Event security and staff at all times.
Governing Law and Severability:
You agree that any and all claims for injury or death arising from the Participant’s participation in the Event shall be governed by Maryland law. You also agree to submit to the exclusive jurisdiction of the State or Federal Courts located in Salt Lake County, State of Utah, for any claim arising from your participation in the Event. If one or more clauses in this Liability Waiver are found to be unenforceable or invalid, that shall not have an effect on any other clause. If possible, any unenforceable or invalid clause in this Liability Waiver shall be modified to show the original intention of the parties.
Each member of your group over the age of 18 will be required to sign a waiver in order to enter the event. Save time by having everyone in your group sign this document. Anyone 17 and under will need a signed waiver from their parent or legal guardian.
